Terms and Conditions

For gig-weekly rentals, these Terms work together with the Gig Weekly Rental Agreement.

By using Drivana, you confirm you can form a binding agreement and will comply with all applicable laws and platform policies.

1) Acceptance and Scope

  • These Terms govern use of the Drivana marketplace, including gig-weekly rentals, host listings, payments, and account services.
  • By creating an account, listing a vehicle, or booking a rental, you agree to these Terms and all referenced policies.

2) Marketplace Role

  • Drivana operates as a marketplace facilitator connecting renters and hosts unless explicitly stated otherwise.
  • Vehicle condition, local legal compliance, and performance obligations remain with the applicable host and renter, subject to platform standards.

3) Eligibility, Verification, and Accounts

  • Users must provide accurate legal identity, license, and payment information and keep account details current.
  • Fraud signals, sanctions screening failures, or identity mismatches may result in decline, suspension, or termination.

4) Payments, Holds, and Fees

  • Rentals may include recurring weekly charges, taxes, optional add-ons, and a refundable deposit authorization hold.
  • Deposit holds may be partially captured for eligible documented charges, including fuel shortfall, tolls, cleaning, smoking, late return, and damage.

5) Cancellations, Disputes, and Chargebacks

  • Cancellation and dispute outcomes are determined using booking records, time stamps, photos, receipts, and in-app messages.
  • Improper chargebacks may lead to account restrictions and collection actions where permitted by law.

6) Prohibited Conduct

  • No illegal use, unsafe driving, account sharing, payment abuse, tampering with telematics, or policy evasion.
  • No scraping, reverse engineering, malware, or unauthorized interference with platform systems.

7) Intellectual Property and Platform Content

  • Drivana and its licensors retain all rights in software, branding, and platform content.
  • User-posted photos, reviews, and listing content may be used to operate, secure, and improve marketplace services.

8) Warranties and Liability Limits

  • Services are provided on an as-available basis to the maximum extent allowed by law.
  • To the extent permitted by law, aggregate platform liability is limited to amounts paid to Drivana for the booking giving rise to the claim.

9) Indemnification

  • Users agree to indemnify Drivana and affiliates against claims arising from policy violations, unlawful conduct, or misuse of the marketplace.

10) Governing Law and Venue

  • These Terms are governed by applicable state and federal law identified in the booking agreement or controlling policy addendum.
  • Venue and dispute process may vary by user location and mandatory consumer protections.

11) Policy Hierarchy and Updates

  • If a booking-specific agreement conflicts with general Terms, the booking-specific agreement controls for that rental.
  • Material updates are posted with an effective date. Continued use after updates constitutes acceptance.
